1. Acceptance of Terms
By downloading or using the RapidResell AI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. We may update these Terms from time to time; continued use constitutes acceptance of any changes.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the App. By using RapidResell AI you represent that you meet these requirements. You are also responsible for complying with any age or eligibility requirements imposed by eBay in your jurisdiction.
3. Acceptable Use
You agree to use RapidResell AI only for lawful purposes and in accordance with these Terms. You must not:
- List items that are prohibited, restricted, or counterfeit on eBay or under applicable law.
- Upload photos or content that infringes any third-party intellectual property rights.
- Attempt to reverse-engineer, scrape, or abuse the App's AI or API infrastructure.
- Use the App to harass, defraud, or harm other users or third parties.
- Circumvent rate limits, create multiple accounts to obtain extra credits, or manipulate the credit system.
We reserve the right to suspend or terminate accounts that violate these rules.
4. eBay Listing Responsibility
RapidResell AI generates listing drafts using AI and posts them to eBay on your behalf. You are solely responsible for reviewing AI-generated content before publishing and for ensuring that your listings comply with eBay's policies, seller agreements, and applicable laws. RapidResell AI is not a party to any transaction between you and a buyer on eBay and accepts no liability for disputes, returns, or eBay policy violations arising from listings you post.
5. Subscriptions and Payments
The App is offered through monthly subscription plans (Starter, Growth, Pro, Business, and Enterprise), each granting a fixed number of credits per billing cycle. Researching a new listing consumes 0.5 credit, and publishing it to eBay consumes another 0.5 credit. If AI research fails, the research credit is automatically refunded. Unused credits do not roll over to the next billing cycle.
Subscriptions are purchased and billed in advance through Google Play, renew automatically each month until cancelled, and can be changed or cancelled at any time in Google Play (Profile > Payments & subscriptions > Subscriptions). Cancellation takes effect at the end of the current billing period. Refunds are handled by Google Play under its policies and are otherwise not available except where required by applicable law.
If a payment fails, your account may be marked past due and new listings may be blocked until payment is resolved in Google Play.
6. Account Termination
You may delete your account at any time from the Settings screen. Upon deletion your personal data will be removed within 30 days, subject to any retention obligations required by law. Unused credits are forfeited upon account deletion. Deleting your account does not cancel your Google Play subscription; cancel it separately in Google Play.
We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if continued access poses a risk to other users or our systems.
7. Intellectual Property
The App, its design, and underlying technology are owned by RapidResell AI and protected by intellectual property laws. You retain ownership of photos and content you submit. By submitting content you grant us a limited, non-exclusive licence to process and store it for the purpose of providing the service (generating listings and posting to eBay on your behalf).
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranty of any kind. We do not warrant that the AI-generated listing content will be accurate, complete, or suitable for any particular purpose. We do not guarantee uninterrupted availability of the service or that eBay listings will be accepted.
9. Limitation of Liability
To the fullest extent permitted by law, RapidResell AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or loss of goodwill — arising out of or relating to your use of the App, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the total amount you paid for the App in the 12 months preceding the claim.
10. Governing Law
These Terms are governed by the laws of the jurisdiction in which RapidResell AI operates, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.
